EMC Takes Paternity Leave Case to Constitutional Court

The Human Rights Education and Monitoring Center (EMC) has submitted a lawsuit to the constitutional court regarding the issue of paternal leave for biological fathers. The EMC has argued that it’s unconstitutional and discriminatory that men don’t have the right to take parental leave in order to take care of newborn child.

“Bearing in mind the fact that taking care of a child isn’t just a right, but is also a responsibility, the plaintiff proves that the law also impinges on the equal rights of women, as this regulation currently renders childcare as the responsibility of women. The law also reinforces discriminatory and patriarchal sentiments in society, which predefine women’s roles and functions, often then affecting children” – says the EMC
